TERMS OF SERVICE – BoatNGo

These Terms of Service (“Terms”) govern your access to and use of the BoatNGo mobile application (“App”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Informational Use Only
BoatNGo is a decision-support tool that provides marine condition data, forecasts, risk scoring, and fishing-related information. The App does not provide navigation commands, emergency services, professional maritime advice, legal advice, or guaranteed outcomes.
Marine and weather conditions change rapidly. You are solely responsible for vessel operation, trip planning, safety decisions, and compliance with all applicable laws and regulations. The App is not a substitute for official marine forecasts, navigational charts, onboard instrumentation, or responsible seamanship.
Boating and marine activities involve inherent risks. You assume full responsibility for all safety decisions and outcomes.
AI Features
The App may provide AI-generated outputs, including fish identification, species suggestions, scoring systems, and fishing hotspot recommendations. AI outputs may be incomplete, delayed, or inaccurate.
All AI-generated results are provided for informational purposes only and must not be relied upon as the sole basis for safety, navigation, regulatory compliance, or harvest decisions.
Regulatory Information
Regulatory information displayed in the App is provided for informational purposes only. Official state and federal regulatory sources control in the event of any discrepancy. You are responsible for verifying current size limits, bag limits, seasons, and area restrictions before engaging in any activity.
Subscriptions and Billing
Certain features of the App require a paid subscription.
BoatNGo Pro Annual — $79.99 per year.
Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You may manage or cancel your subscription at any time through your Apple ID account settings. Billing and subscription management are handled exclusively by the Apple App Store or Google Play Store under their respective terms. BoatNGo does not process payment card information directly.
Acceptable Use
You agree not to:
Misuse the App or its services
Attempt unauthorized access
Reverse engineer protected components
Interfere with system integrity
Use the App in violation of applicable law
Intellectual Property
All software, content, data models, scoring systems, branding, trademarks, and materials within the App are owned by BoatNGo or its licensors and are protected by intellectual property laws. Unauthorized copying, distribution, modification, or exploitation is prohibited.
Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOATNGO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOATNGO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY DAMAGES ARISING FROM YOUR USE OF OR RELIANCE ON THE APP.
Indemnification
You agree to indemnify and hold BoatNGo harmless from any claims, damages, losses, liabilities, and expenses arising from:

Your violation of law
Your breach of these Terms

Age Requirement
The App is not intended for individuals under 13 years of age.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
